These Terms of Service ("Terms") govern your access to and use of the Answer Right AI website and the AI answering services provided by Answer Right AI ("we," "us," "our"). By using our website or engaging our service, you agree to these Terms. If you do not agree, do not use our service.
1. Acceptance of Terms
By submitting our contact form, signing a service agreement, or using any service we provide, you affirm that you are at least 18 years old, are authorized to enter into these Terms on behalf of yourself or the business you represent, and agree to be bound by these Terms and our Privacy Policy.
2. Description of Service
Answer Right AI provides AI-powered telephone answering services for businesses, including:
- Inbound call answering by an AI voice agent
- Outbound AI follow-up calls to leads who have opted in
- SMS notifications, lead capture, and CRM integration
- Call recording, transcription, and structured data extraction
- Custom configuration of the AI agent's prompts, knowledge base, and integrations
Specific features depend on the plan you select. We may change, add, or remove features at our discretion. Material changes affecting active customers will be communicated in advance.
3. Communications Authorization
By providing your phone number through our website contact form with the consent checkbox checked, you authorize Answer Right AI to contact you by phone call and SMS, including by means of automated telephone dialing systems, prerecorded messages, and artificial intelligence voice technology, at the number provided. This authorization is not a condition of any purchase. Standard message and data rates may apply. You may revoke authorization at any time as described in our Privacy Policy.
4. Pricing and Payment
Pricing for our services is provided at the time of engagement. Plans are billed monthly in advance unless otherwise agreed in writing. Setup fees, if any, are charged before service activation. All fees are in U.S. dollars and are non-refundable except as required by law or as expressly stated in your service agreement.
We may adjust pricing with at least 30 days' written notice. Continued use of the service after the effective date of a price change constitutes acceptance.
5. User Responsibilities
You agree to:
- Provide accurate, current information when configuring your AI agent
- Use the service only for lawful business purposes
- Comply with all applicable laws regarding telephone communications, including TCPA, CAN-SPAM, state privacy laws, and any industry-specific regulations relevant to your business
- Obtain any necessary consents from your own customers before having our AI agent contact them on your behalf
- Not use the service to send spam, harass anyone, attempt fraud, or impersonate others
- Maintain the security of any credentials we provide you
You are responsible for the content of communications sent through the service on your behalf, including the accuracy of information your AI agent provides to your callers.
6. Intellectual Property
All content on our website, our AI agent configurations, our software, and our brand are owned by Answer Right AI or our licensors. You receive no ownership rights in any of the foregoing. You retain all rights in the data you provide to us (your business information, your customer data) and grant us a limited license to use that data solely to provide the service.
7. Disclaimers
The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, accuracy, or non-infringement.
We do not guarantee:
- That the service will be uninterrupted, error-free, or fully secure
- That the AI agent will respond perfectly to every call or query
- That call quality, transcription accuracy, or extracted data will be flawless
- Any specific business outcome from using the service
You acknowledge that artificial intelligence systems can make mistakes. You are responsible for reviewing call recordings, transcripts, and extracted data and for taking appropriate action when accuracy matters.
8. Limitation of Liability
To the maximum extent permitted by law, Answer Right AI and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, arising out of or related to the service, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising out of or related to these Terms or the service will not exceed the amount you paid us for the service in the three (3) months preceding the event giving rise to the claim.
9. Indemnification
You agree to indemnify and hold harmless Answer Right AI from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of (a) your use of the service, (b) your violation of these Terms, (c) your violation of any applicable law including TCPA, or (d) any content or instructions you provide that cause the AI agent to act improperly.
10. Termination
You may cancel your service at any time per the terms of your service agreement. We may suspend or terminate your access if you violate these Terms, fail to pay fees when due, or use the service in a manner that creates risk for us or our other customers. Upon termination, your right to use the service ends immediately. Sections of these Terms that by their nature should survive termination (e.g., intellectual property, disclaimers, limitations of liability, indemnification) will survive.
11. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Utah, without regard to conflict of law principles. Any dispute arising out of these Terms or the service will be resolved in the state or federal courts located in Salt Lake County, Utah, and you consent to the personal jurisdiction of those courts.
12. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent change. Material changes affecting active customers will be communicated by email at least 14 days before taking effect. Continued use of the service after the effective date constitutes acceptance.
